How do I work out if my employee is eligible for Statutory Maternity Pay?
Your employee must have at least 26 weeks of continuous service by the 15th week before the baby is due to be born.
What happens if my employee is not eligible to receive maternity pay?
Your employee may be eligible to receive Maternity Allowance instead. The employee will need to go to the local JobCentre Plus to make an application for Maternity Allowance and will need you to provide a completed form SMP1 which is evidence as to why you cannot pay Statutory Maternity Pay.
