My business is very small and there is no one else who can hear the Appeal. What can I do?
You should consider using an external party that is connected to your business for example your accountant or solicitor but that can be costly. Equally you could use an HR professional to act as an objective third party.
If I think the decision at the original hearing was too light, can I impose a harsher penalty?
No – you can either uphold the original decision or overturn it and impose a lesser sanction.
Does my employee automatically have the right of appeal?
Yes – an employee has the right to appeal any decision taken at a formal meeting. There is only 1 stage to the appeals process and the decision of the appeal chairman is final.
