Is it just temporary workers that are working through an agency who are affected by the Agency Workers Regulations?
Yes - ordinarily those who are genuinely self-employed or who work under a limited company will not have any rights under the regulations.
We have several fixed term contractors – are they affected?
If you source a worker on a fixed term contract via an agency but the fixed term contract is directly with you and is in effect an employment contract with a fixed start and end date, then they are not considered to be a temporary worker.
We have several workers who are either self-employed or work through a limited company – are they in scope?
No – the rules only affect workers who are provided via a temporary agency.
