Are there separate entitlements to different types of benefits?
Yes – temporary workers will be entitled to access some benefits from day 1 and others after they have completed 12 weeks’ continuous service in the same job.
What benefits are temporary workers entitled to from day 1?
The temp is entitled to have access to the same common/rest areas, canteens and breaks, childcare and transport arrangements as their permanent counterparts.
What benefits are temporary workers entitled to after completing 12 weeks continuous service?
Upon completion of 12 weeks’ continuous employment, temporary workers will be entitled to receive all the same basic terms and conditions of employment as their permanent counterparts including pay, holiday and holiday pay, maternity rights and bonuses based on individual performance.
I offer terms and conditions above the basics required – are temporary agency workers entitled to claim the same as the enhanced conditions?
No – the temporary worker is only entitled to the same basic terms and conditions of employment. Therefore a temporary worker is not entitled to the same bonuses based on company performance (rather than individual performance), private medical/permanent health/life insurance benefits, company pension schemes, enhanced maternity/paternity/adoption entitlements, redundancy pay (contractual and statutory) or notice pay.
